Terms of Service

1. Scope

These terms apply to all services provided by smpl Services GmbH via https://smpl.video and associated platforms.

2. Services Provided

We provide a video streaming platform ("SMPL VIDEO") allowing users to:

• Launch and manage streaming apps and channels

• Upload and distribute video content

• Use monetization models (SVOD, AVOD, TVOD, EST)

• Access backend tools and analytics

3. Account & Access

To use the platform, users must register and provide accurate information.
The account holder is responsible for all activity conducted through their credentials.

4. Content Responsibility

Users are solely responsible for the content they upload or distribute.
You may not upload or share any content that:

• Infringes on copyrights or intellectual property

• Is illegal, hateful, violent, or pornographic

We reserve the right to remove content that violates these terms.

5. Payment Terms

Pricing is based on selected plan + dynamic usage-based costs (traffic, storage, processing).
Invoices are issued monthly. Late payment may result in account restrictions.

6. Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service.
Scheduled maintenance will be communicated in advance where possible.

7. Liability

We are not liable for indirect damages or data loss unless caused by gross negligence or intent.
Our liability is limited to the total paid amount in the past 12 months.

8. Termination

Either party may terminate the agreement with 30 days’ notice.
smpl may suspend or terminate service immediately in case of serious breach.

9. Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany.
Place of jurisdiction: Berlin.
